These general terms and conditions of sale apply as of right to any sale of Services provided in Arkose bouldering and route climbing Lofts, entered into between the Member and the company Arkose&Co, or one of its French subsidiaries or one of its franchisee partners.
Any sale implies the Member's prior acceptance of these general terms and conditions of sale. The Member thus acknowledges having read them before placing an order and accepts them unreservedly in their entirety. The applicable general terms and conditions of sale are those in force on the day of the sale. They cancel and replace in all their provisions those that may have been previously accepted by the Member. The Company reserves the right to adapt or modify these general terms and conditions of sale at any time and to publish them on its website.
The Member also acknowledges having read, prior hereto, the house rules which supplement the general terms and conditions of sale and specify the terms of access to the facilities as well as the basic rules for their use. Included in the house rules are all instructions posted in Arkose bouldering and route climbing Lofts. The Member agrees to comply with them unreservedly. The house rules may be modified at any time, which will be brought to the Member's attention by posting in Arkose bouldering and route climbing Lofts or on their respective websites.
Whenever used, terms whose first letter of each word is capitalized shall have the meaning assigned to them below, whether in the singular or plural:
The Member subscribes to one of the Services described below. Any subscription made by or for a Member is personal and non-transferable.
2.1. Climbing
The climbing Services described below grant access to all areas of all Lofts, unless special conditions apply, for the duration of the Service and according to the terms described in the HR. The spaces and services made available to Members may vary from one Climbing Loft to another. The use of any Package purchased online is conditional upon a first visit to the Loft chosen at the time of purchase. However, if this first visit takes place in another Loft applying a higher rate, the Member shall be required to pay the price difference.
Members who have subscribed to a Fixed-term or Indefinite-term Package or a 10-Session Package can access the lofts of the Mroc network. The Member then agrees to comply with the Mroc house rules available at mroc.fr.
The monthly guest passes included in Fixed-term and Indefinite-term Packages are usable from the first day of the subscription over a period of thirty (30) to thirty-one (31) days depending on the current month and cannot be accumulated over several months. The Member must be present each time and will specify at the Loft reception the number of sessions used for the current month.
Members subscribing to a "Happy Hour" Fixed-term or Indefinite-term Package must strictly comply with the access hours provided for the subscription in question. When the subscription gives access to yoga and/or pilates classes, these are reserved according to the terms described in Article 2.2.
Fixed-term Packages are subscribed for a fixed period, defined at the time of subscription, and in accordance with the special conditions applicable to each type of subscription. Payment is due in full on the day of subscription. Upon payment, the subscription becomes firm and definitive, without the possibility of early termination except under the conditions provided in Article 5.1.3. The Fixed-term Package automatically ends at the end of the agreed period, without tacit renewal.
Indefinite-term Packages, known as "monthly", are subscribed for a duration of thirty (30) or thirty-one (31) days, tacitly renewable. Payments are debited on the date chosen by the Member from the day of subscription for periods of one calendar month (from date to date). Thus, the Member authorizes the Company to debit the amounts due at the chosen monthly frequency provided that they complete a SEPA direct debit mandate accompanied by bank details (RIB). The Member may, if they wish, have their debit date modified. They must inform the company at least eight (8) days prior via the contact form available on the website https://arkose.com/nous-contacter.
The Member may pay for their session individually or purchase a Multi-session Package. Sessions are usable without time limits and in accordance with the special conditions applicable to each type of Session Package. Payment is made in full on the day of the order. Upon payment, the subscription becomes firm and definitive. If the Member decides to convert their ten (10) entry Session Package into a Fixed-term or Indefinite-term Package, the balance of remaining sessions on their account will be deducted from the amount of the new formula subscribed.
Supervised climbing classes are offered to adults and children during the school term, according to the duration, schedules, rates, and terms displayed at the reception or on the website of the Loft where registration is made. Climbing courses/camps are offered in the same way for children during school holidays. Children's classes and courses are offered by age category. Unless prior agreement from the Company, the Member must be of the required age for the classes in which they are enrolled on the day of the first class, failing which the registration may be terminated as of right by the Company. The Member cannot modify the class or course time slot for which they enrolled. Classes and courses are paid in full on the day of registration. Upon payment, the Member's registration becomes firm and definitive, without the possibility of early termination except in the case set out in Article 5.1.3 for classes. In the event of inappropriate behavior by the child, particularly non-compliance with the HR, the Company reserves the right to dismiss the child, without possibility of refund.
The Company offers birthday packages for children, under the price, schedule, and reception conditions defined by each Loft offering this Service. This package is paid in full on the day of its subscription. Upon payment, the sale becomes firm, definitive, and non-cancellable.
2.2. The Arkose Studio
The Member can register for classes offered by Studio Arkose (yoga, pilates, etc.) by subscribing to:
These services are paid in full on the day of subscription. Upon payment, their subscription becomes firm and definitive.
Class bookings by the Member are made at the reception of the Loft where the order was placed or via its website, under the "Book" tab, up to fifteen days maximum before the desired slot. Once booked, the slot must be honored. Upon the third absence, the Member will be deprived of the ability to book a class for two weeks. "Studio" Services grant access to all Loft areas, excluding climbing. All studio Services may vary from one Loft to another.
3.1. Applicable prices
Applicable prices are inclusive of all taxes (TTC). They are displayed at the reception or on the website of the Loft where the Member places an order.
For Indefinite-term Packages, the Company reserves the right to modify its prices at any time. Any price modification applicable to an ongoing contract will be brought to the Member's attention on a durable medium (e.g., by email) at least thirty (30) days before its effective date. The Member will have the option, up until that date, to terminate their Package without notice and free of charge if they refuse this price modification. Services already provided at the effective date of termination will remain due, and any sum paid for a period after this date will be refunded pro rata temporis. Failing termination before the new prices come into effect, they will be deemed definitively accepted by the Member.
For Fixed-term Packages and other Services (Session Package, classes, courses/camps, birthday package, and Studio Arkose), the applicable price is the one in force on the day of sale and remains unchanged for the entire duration initially agreed upon.
Reduced rates are applied subject to presenting valid proof (ID card, professional card, etc.) on the day of subscription. Eligible for reduced rates are individuals aged 12 to 25 inclusive, police officers, firefighters, and military personnel. Regarding Indefinite-term Packages, the benefit of the reduced rate is strictly subject to maintaining eligibility conditions throughout the contract. The Company reserves the right to carry out regular checks, in particular by visual inspection of updated proof by reception staff. In the event of loss of status entitling to the reduced rate (e.g., 26th birthday) or failure to present valid proof within one (1) month following the Company's request, the standard rate in force will automatically apply.
3.2. Additional fees
Administrative fees are due and invoiced once upon the first subscription by a Member to a Fixed-term or Indefinite-term Package or a Session Package. These fees are non-refundable.
For minors under fifteen (15) years old holding a Card, a new card may be issued to them, subject to replacement fees, in case of loss or theft.
3.3. Accepted payment methods
The Member may pay for all services by:
The Member can find the details of their order and related documents in their customer area.
3.4. Deferred/Instalment payment
Instalment payment (in 3 or 4 installments) is available via our partner Alma. Payment security is provided by Alma and its service providers. Alma's credit service is offered for the payment of purchases and execution of payment, subject to the Member purchasing the goods or services through Alma accepting the installment or deferred payment agreement. Only purchases between €350.00 and €3,000.00, excluding promotions offered by the Lofts and excluding monthly subscriptions, are eligible for payment with Alma.
When paying with Alma, the Member incurs no fees. As a representative example:
The first payment will be made on the day of purchase, and subsequent payments will be debited monthly until the end of the payment schedule provided by Alma. Warning: A credit commits you and must be repaid. Please verify your repayment capacity before committing. This service is provided subject to acceptance by Alma SAS, a financing company authorized by the ACPR (CIB code: 17408), registered with the Nanterre Trade and Companies Register (RCS) under number 839100575.
Any refusal to grant installment or deferred payment by Alma may result in the voidability of these GTC, unless the Member agrees to pay for the purchase in full. In the event of termination of the GTC, the installment or deferred payment contract will be automatically terminated. In case of withdrawal from the installment or deferred payment solution used for payment, the GTC will be automatically terminated, unless the Member pays for their purchase in full through Alma.
In accordance with Article L.312-50 of the Consumer Code, in the event of payment in instalments, including the payment of a deposit, the Member is provided with a receipt on paper or any other durable medium acting as a receipt and containing the full text of the provisions below (Articles L. 312-52, L. 312-53, and L. 341-10 of the Consumer Code):
Article L312-52: The contract for sale or provision of services is automatically cancelled without indemnity:
1° If the lender has not, within seven days from the acceptance of the credit agreement by the borrower, informed the seller of the granting of credit;
2° Or if the borrower has exercised their right of withdrawal within the period provided for in Article L. 312-19.
However, when the borrower, by express request, asks for the immediate delivery or provision of the goods or services, the exercise of the right of withdrawal from the credit agreement only entails automatic cancellation of the sales or service agreement if it occurs within three days from acceptance of the credit agreement by the borrower. The contract is not cancelled if, before the expiration of the time limits mentioned in this article, the buyer pays in cash/full.
Article L312-53: In cases of cancellation of the contract of sale or services provided for in Article L. 312-52, the seller or service provider shall refund, upon simple request, any sum that the buyer may have paid in advance toward the price.
Article L341-10: In cases of cancellation of the sales or service contract provided for in Article L. 312-53, as from the eighth day following the request for refund of any sum paid in advance by the buyer, this sum shall bear interest as of right at the legal interest rate increased by half.
In case of questions or complaints related to the Alma Pay payment service, the Member can contact Alma by email at support@getalma.com. Support is available seven days a week. The Member can also visit the following website: https://help.almapay.com/.
3.5. Gift cards
The Company offers gift cards and gift products for sale on its website and in Lofts, allowing all or part of the Arkose experience to be offered in its Lofts. The offer includes face-value gift cards, usable for purchases in the climbing, canteen, shop, and studio areas of the Lofts, and gift products corresponding to specific services.
Face-value gift cards allow their beneficiary to pay, up to the limit of their available balance, for all or part of the eligible products and services offered by the Company in the Lofts. They can be used in one or more installments, within the limit of the available balance, according to the terms specified at purchase. In the case of a purchase exceeding the available balance, the difference must be settled by any other payment method accepted by the Company. In the case of a purchase lower than the available balance, the remaining balance remains usable until the gift card's expiration date.
Gift products corresponding to a specific service entitle the holder exclusively to the service or package of services described at the time of purchase. They cannot be used for another service or converted into a face-value gift card. When a gift product is subject to special access or eligibility conditions, these apply to the beneficiary.
The gift card or gift product is valid for twelve (12) months from its date of purchase. Upon expiration of its validity period, the gift card or gift product can no longer be used. Unused balances or services, in whole or in part, are lost. Gift cards and gift products are neither exchangeable for cash nor refundable, even partially, including in cases of loss, theft, damage, or expiration. They do not give rise to any change being returned.
4.1. Opening hours
Opening hours of the Lofts are displayed at reception, on their respective Sites, or on the Arkose+ application. Any potential changes will be brought to Members' attention (e.g., summer hours, public holidays, etc.), but do not entitle Members to any compensation.
4.2. Access for minors
Access conditions to the Lofts for minors are summarized in the following table:
| Age | Bouldering | Route Climbing |
|---|---|---|
| Under 12 years old | Accompanying adult mandatory. No access to adult climbing areas, except upon validation of a Visarkose certification by an instructor, granting access only to the validated difficulty level. | Accompanying adult mandatory. |
| From 12 to 15 years old inclusive | Independent access allowed subject to a completed and signed parental authorization. | Accompanying adult mandatory. |
| 16 years old and over | Independent access. | Independent access allowed subject to a completed and signed parental authorization. |
Parental authorization is provided upon order placement and is also accessible on the Lofts' website. The Member undertakes to ensure compliance with all provisions of these GTC and HR by the minor for whom they are the legal representative.
4.3. Access control and identification
Access to the Lofts is achieved via a personal, nominative, and non-transferable QR Code. The QR Code is generated within the Arkose+ mobile application, accessible after installation (via Apple Store or Play Store) and logging into the Member's personal account. The QR Code must imperatively be presented to reception staff at the entrance of the Loft before being able to enter. Exceptionally, a physical personal and nominative Card may be issued upon request to minors under fifteen (15) years of age. It is strictly forbidden to lend, assign, or share the QR Code or Card with a third party. In case of loss, theft, or inability to access the QR Code or Card, the Member undertakes to inform the Company without delay.
4.4. Required equipment and return conditions
Wearing climbing shoes is mandatory to access the climbing area. Failing this, the Member may be denied entry. Each loft has a climbing shoe rental service available to the Member. In route climbing lofts, a harness and belay system are mandatory. No personal ropes may be used. The Loft makes this equipment available to the Member.
Any rented or borrowed equipment must be returned in perfect condition at the end of the session or at the end of the loan/rental period. Any damaged or unreturned equipment will be billed to the Member.
4.5. Members' personal belongings
Lockers are available to Members so they can leave their personal belongings for the duration of the session. Members use them independently. They must bring their own padlock to lock them. They must ensure that the padlock used provides sufficient security to prevent theft and that the locker is properly locked before any session. The Member must also ensure not to leave any valuables in the locker and leave them, if necessary, at the Loft reception. They must imperatively leave the locker empty at the end of their session.
4.6. Compliance with internal regulations and right of exclusion
In addition to these GTC and HR, the Member agrees to strictly comply with all rules and instructions, particularly regarding hygiene and safety, which may be given verbally or posted by Loft staff.
The Member acknowledges Loft management's right to temporarily exclude, with immediate effect and for a maximum duration of seven (7) days, any person whose breach is of such gravity that it makes it impossible to maintain the Member in the Loft or compromises the safety of persons or property (notably in cases of safety, hygiene, violence, threats, or harassment referred to in Article 5.2.1.). This measure, essential to guarantee safety and good order within the Lofts, does not entitle the Member to any compensation of any kind and may be followed by the termination procedure provided for in Article 5.2.1.
5.1. Termination at the Member's initiative
Birthday packages, camps, Session Packages, and Studio entry passes are non-refundable.
The Indefinite-term Package may be terminated at any time by the Member, without needing to provide justification. This process is subject to one (1) month's notice. This one (1) month notice period may, however, be reduced if the Member provides proof of one of the reasons detailed in Article 5.1.3. Any month started is considered due in full.
Fixed-term Packages, and classes are subscribed for a firm and definitive duration and cannot be terminated prior to their initial term. The only accepted cases of early termination are:
Upon validation of the request, the Member will be refunded by bank transfer an amount calculated pro rata for the remaining period until the end of the initially subscribed Service.
To terminate a subscribed Service, the Member may submit a request:
In the context of early termination under Article 5.1.3, the Member must imperatively send valid supporting documents (medical certificates, employer statements, etc.) through one of these channels. Termination takes effect on the date of receipt of the request, accompanied by all required supporting documents where applicable.
5.2. Termination at the Company's initiative
The Company reserves the right to terminate the contract as of right in the event of a serious or repeated breach by the Member of their contractual obligations, these GTC, or the HR, and notably in the following cases:
The cases listed above are given as examples of breaches that may justify termination as of right by the Company.
Unless the breach committed makes it impossible to maintain the contract or justifies an immediate cessation of access to the Loft for safety reasons, termination can only occur after sending a formal notice explicitly stating the intention to enforce this clause, which has remained without effect for a period of one (1) month. During this period, the Member may submit written observations on the facts alleged against them. At the end of this period:
When the committed breach concerns a payment default, a single payment incident leads to the suspension of the QR Code or Card until full payment of the sum due. As of two (2) or more payment defaults, consecutive or not, the Company may terminate the contract as of right. This termination will take effect within the month following the dispatch of a formal notice indicating the intention to enforce this clause, which has remained unsuccessful. This suspension or termination does not apply if the payment incident results from the fault of a third party or a malfunction of the payment system not attributable to the Member. The latter undertakes, as soon as they become aware of it and within seven (7) calendar days following notification of the incident, to communicate to the Company any relevant supporting evidence available to them.
In the event of termination pronounced for one of the breaches referred to in this article, any sum already paid by the Member will remain definitively acquired by the Company. Furthermore, these terminations do not prevent the Company from initiating any legal proceedings it deems appropriate, and in particular from pursuing the recovery of sums remaining due by the Member until the initial term of their Contract.
In the event of the permanent closure of a Loft located outside the Paris region, and when no other network Loft is located within twenty (20) kilometers of the closed Loft, the Contract may be terminated as of right by the Company. The Member is then refunded by bank transfer for the amount corresponding pro rata to the period between the closure of the Loft and the initially scheduled end of their Contract or, in the case of Studio passes or Session Packages, for the number of entries unused by the Member on the date of closure of the Loft.
The Member cannot claim any refund in the event of closure of a Loft located in the Paris region, except where the classes in which the Member enrolled cannot be continued in another Loft due to lack of space or incompatible schedules. In this specific case, the Member indicates whether they wish to:
6.1. Suspension at the Member's initiative
The Member may request the suspension of their Indefinite-term Package at any time under the conditions provided in Article 6.1.3, without needing to provide justification, and for a duration equal to or greater than one (1) month and less than or equal to six (6) months.
In the event of suspension, the direct debit for the month in which the request is made is maintained, while debits for subsequent months are frozen until the resumption date. At the end of the suspension period, debits resume automatically. The Member is required to inform the Company in advance of their resumption date.
The Member may request the suspension of their Fixed-term Package upon presentation of a valid medical certificate proving a temporary inability to use their package, for a duration equal to or greater than one (1) month and less than six (6) months. The Package may then be suspended or extended by the duration indicated in said medical certificate, in increments of one (1) month, subject to informing the Company as soon as possible and providing the relevant supporting document.
To suspend their Fixed-term or Indefinite-term Package, the Member may submit a request:
The Contract (Fixed-term or Indefinite-term Package, classes, and courses/camps only) may be suspended or extended at the Company's initiative in the event of Loft closure for works or force majeure, under the same conditions as Article 6.1.1. In the event of temporary closure of the Loft for a duration of less than fifteen (15) days, the subscription will neither be suspended nor extended.
The Contract (Fixed-term or Indefinite-term Package, classes, and courses/camps only) may be suspended or extended at the Company's initiative in the event of Gym closure for works or force majeure, under the same conditions as Article 6.1.1. In the event of temporary closure of the Gym for a duration of less than fifteen (15) days, the subscription will neither be suspended nor extended.
In accordance with Article L221-18 of the Consumer Code, the Member has a period of fourteen (14) days to exercise their right of withdrawal from a contract concluded remotely, following off-premises soliciting or off-premises contracts, without having to give reasons for their decision.
To exercise this right, the Member must notify the Company, before the expiration of the aforementioned period, of their decision to withdraw by means of the standard withdrawal form made available in their customer area or any other unambiguous statement, sent:
In the event of exercising the right of withdrawal, the Company refunds the sums paid using the same payment method used during the purchase.
In accordance with Article L.221-28 of the Consumer Code, individuals enrolled in classes (climbing, yoga, pilates, etc.), courses/camps, and birthday parties do not benefit from the fourteen (14) day right of withdrawal.
In accordance with Articles L321-1 et seq. of the Sports Code, Arkose&Co is insured with AXA FRANCE IARD SA, whose registered office is located at NANTERRE CEDEX (92727) 313, Terrasses de l’Arche, under insurance policy No. 11298795304, for damages incurring its civil liability and that of its employees.
Services provided by franchisee partners are covered by insurance policies taken out by each of them (the details of which can be consulted in the “Legal Notices” section on the Site).
The Member is invited to take out personal third-party liability insurance, covering them or covering the minor for whom they are the legal representative, against any personal injury (reparations for physical harm) or property damage, of which they could be a victim or that they could cause to third parties, in the context of the activities under the Contract linking them to the Company. It is their responsibility to take out an insurance policy with an insurer of their choice, or to check with their current insurer that they have the necessary coverage for this purpose, prior to subscribing to any Service.
Practicing a sport involves risks. The Member must be able to evaluate their own capabilities. They are responsible for how they practice sport and the choices they make in this regard. They thus take all necessary precautions to ensure their own safety or that of the minor for whom they are the legal representative and will ensure compliance by themselves, or by the minor, with all safety rules communicated to them. The Member certifies, however, that their physical condition and state of health, or those of the minor for whom they are the legal representative, allow them to practice sport in general, and more specifically bouldering climbing where falls onto mats are inevitable.
The telephone contact details provided by the Member may be used by the Company when necessary for the management and execution of the Contract. The Company does not engage in unsolicited telephone marketing for commercial purposes. Any commercial solicitation by phone requires the prior consent of the consumer, except when it occurs within the framework of executing an ongoing contract and is related to the subject of that contract. Acceptance of these GTC does not constitute consent to receive telephone calls for commercial prospecting purposes.
The personal data that the Member has communicated to the Company (such as last name, first name, photograph, phone number, email address, etc.) are collected and processed by the Company to enable it to execute all Services. It is specified that, to secure access to facilities and verify the Member's identity at Climbing Loft access points, the Company may request the submission of an ID photograph or take one directly upon registration. This photograph is used exclusively for access control and Member identity verification. It is not subject to any dissemination, transfer to third parties, or commercial use by the Company.
The data thus collected are processed in accordance with the Personal Data Protection Policy established by the Company, in its capacity as Data Controller, which can be found on the website www.arkose.com (Privacy Policy section). This personal data is processed and stored in accordance with the provisions of said Policy.
The IT processing of the Member's file within the framework of the Data Protection Act of January 6, 1978, as amended, and Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 (GDPR), opens a right of access, rectification, opposition, restriction, portability, and erasure of the Member's personal file data. To exercise their rights, the Member may submit any request:
The request must specify the Member's last name, first name, and the subject of the request. Where necessary, it is specified that the Member's exercise of their right to object, restrict, port, or erase their personal file data may lead to the impossibility for the Company to execute the subscription or any other offered service.
The Member may submit any complaint regarding the performance or interpretation of these general conditions, or any other related contractual document:
In the event of failure, the Member may, pursuant to Articles L.611-1 et seq. of the Consumer Code, resort free of charge to the CM2C mediation service (Centre de la Médiation de la Consommation de Conciliateurs de Justice), either by filling out the form directly on the CM2C website (www.cm2c.net), or by contacting CM2C by email at cm2c@cm2c.net or by post at CM2C 14 rue Saint Jean 75017 PARIS.
In accordance with Article L612-2 of the Consumer Code, recourse to mediation is only possible if the following conditions are met:
These GTC are subject to French law. They are drafted in the English language. In the event that GTC are translated into one or more languages, only the French text shall be authentic in the event of a dispute.
